In a very important decision for workers injured in Montana, the Montana Supreme Court in the case Talbot v. Cudd, 2016 MT 247, reaffirmed the rights of injured workers to be made whole before workers compensation insurance companies can seek repayment of medical bills and lost wages it paid for. Allen Ginn suffered a brain injury, among other injuries, when a log fell on him at a Smurfit-Stone Container Corp. mill in 2008. Ginn, a logger, was injured while he delivered a truckload of logs to the mill. The catastrophic injuries Ginn suffered required him to incur extensive medical bills and caused him to lose his logging business. As reported by the Great Falls Tribune, Zander Blewett of the Montana personal injury law firm Hoyt and Blewett donated $20,000 to the Boys and Girls Club of Cascade County, a non-profit organization in Great Falls, Montana. The funds were used to purchase a new large red van to transport at-risk youths to various after-school programs sponsored by the Boys and Girls Club. The State of Montana and the Center for Mental Health have agreed to pay $2,100,000 to settle claims brought by 16 former members of the Montana Public Employee Retirement System (MPERS). In the settlement, the State of Montana paid $700,000 and the Center’s insurers paid $1,400,000. The lawsuit Baker et. al vs. State of Montana, CDV-11-0801 filed in Great Falls, Montana, in Cascade County State District Court involved 16 former members of the MPERS who claimed that both the State and the Center misrepresented to them their eligibility for membership in the MPERS when each applied for employment at the Center.

KRTV news recently reported that attorneys from the Hoyt and Blewett law firm obtained a $600,000 settlement for a boy who suffered brain injuries in a 2003 car accident which occurred near Great Falls, Montana.

In a unanimous decision, the Ninth Circuit Federal Court of Appeals has affirmed a $2.5 million verdict rendered by a Butte jury in a wrongful death lawsuit involving a trucking accident which occurred in Montana. In the case Messick/Bowman v. Patrol Helicopters, Plaintiffs filed a wrongful death lawsuit against Patrol Helicopter alleging that the driver of a truck failed to signal and caused the deaths and serious injuries of the Plaintiffs who were in a vehicle which attempted to pass the truck.
